Information on Brexit

On 24 December 2020, an "EU-UK Trade and Cooperation Agreement" was concluded between the European Union and the United Kingdom, which provides for preferential arrangements in, inter alia, trade in goods and transport. Below is a list of some of the provisions:

  • A transit procedure is necessary for rail transport through the Channel Tunnel.
  • The United Kingdom has become a party to the Convention on a common transit procedure, which will be used for the movement of goods by rail in all directions between the United Kingdom and EU Member States, EFTA countries, Turkey, Northern Macedonia and Serbia.
  • The United Kingdom is no longer subject to EU single market and customs union rules and the free movement of goods between the United Kingdom and the EU has ended.
  • Customs procedures and formalities now apply to all goods transported to and from the United Kingdom (with some simplifications).
  • Animal and plant products originating in the United Kingdom must be health-certified and subject to health and phytosanitary controls at Member States' border inspection posts (which appears to be problematic in the case of transport through the Channel Tunnel).
  • Wood packaging material (WPM), including pallets and crates, must comply with international ISPM15 standards for treatment and corresponding marking. The WPM may be inspected upon entry into the United Kingdom to verify compliance with ISPM15 requirements.
  • The ENS and EXS requirements for goods coming to and from the UK must be met. The United Kingdom has temporarily waived the requirement to declare an ENS for goods imported into the United Kingdom from the EU between 1 January 2021 and 30 June 2021. For goods coming from the United Kingdom into the EU, the ENS is mandatory from 1 January 2021.
  • The EU-UK agreement provides for zero rates and zero quotas for all goods, but in order to benefit from these exceptional trade preferences, products must meet the requirements of the "rules of origin" (proof of origin will be required).
  • The EU and the United Kingdom have agreed on mutual recognition of Trusted Traders Programs (AEO - Authorized Economic Operators - for the EU).
  • The agreement does not contain detailed provisions on customs settlement, so all open points will need to be clarified in the coming weeks. However, EU legislation on customs procedures will continue to apply and the British border operating model sets out customs procedures for the United Kingdom.
