Introduction of the obligation to submit ENtry Summary Declaration (ENS) in the ICS2 system

Effective from September 1, 2025, the obligation to submit an entry summary declaration (ENS) via the trans-European ICS2 (Import Control System 2).

Effective from September 1, 2025, the obligation to submit an entry summary declaration (ENS) via the trans-European ICS2 (Import Control System 2) at the point of entry into the EU will come into force, within specified time periods depending on the type of transport.

The aim is to ensure that data on the consignment is provided to the customs authorities in sufficient time for the purpose of carrying out a risk analysis in the area of safety and security, before the goods enter the EU territory.

The submissions are made exclusively electronically via the ICS2 system

The obligation to submit an ENS applies to all railway consignments entering the EU from third countries, including cases where the transport takes place between EU countries but passes through a third country, e.g. Serbia.

Cases where the obligation to submit an ENS is waived are set out in Article 127(2) of Regulation (EU) No 952/2013 and Article 104 of Commission Delegated Regulation (EU) 2015/2446.

The following ENS submission deadlines apply to rail transport

a) pokud cesta vlakem z poslední stanice pro sestavování vlaků umístěné ve třetí zemi k celnímu úřadu prvního vstupu trvá méně než dvě hodiny, nejpozději jednu hodinu před příchodem zboží do místa, pro něž je tento celní úřad příslušný;

b) ve všech ostatních případech nejpozději dvě hodiny před příchodem zboží do místa, pro něž je příslušný celní úřad prvního vstupu.

Transitional period

From April 1, 2025, to September 1, 2025, there is a transitional period during which it is possible to test the ICS2 system and prepare for its full implementation. After September 1, 2025, consignments will be prevented from entering the EU unless the ENS is submitted properly and on time.

Requirement to provide data in column 21 of the CIM consignment note

From August 18, 2025, consignments sent from the Czech Republic to EU member states via a third country will be required to include the following information in the CIM consignment note:

  • Entity responsible for submitting the entry summary declaration (ENS) – name, EORI identifier
  • Place of entry into the EU for which this declaration will be submitted.

Detailed information on the ICS2 system can be found on the official websites of the Customs Administration of the Czech Republic or of the European Commission.

ČD Cargo, a.s. is not a rail carrier at the EU entry border and therefore it will not submit ENS via the ICS2 system, as the Czech Republic does not share land borders with third countries.

However, given that these new obligations affect some of the transport services provided by our company, the relevant requirements will be incorporated into the Contractual Transport Conditions of ČD Cargo.
